It should be noted that the U.S. Department of Homeland Security (DHS) has stated a vital change to Form I-9, Employment Eligibility Verification, which comes into effect from 1 August 2023. Please keep in mind that the revised form comprises numerous changes, the most prominent being a checkbox for companies registered in E-Verify to specify that they have evaluated copies of identity and employment authorization credentials under a new substitute document examination procedure.
Alternative Document Examination Procedure
It should also be noted that the DHS has permitted this alternative procedure, which grants certain organizations to evaluate copies of Form I-9 documents in place of the previous obligation of in-person, physical confirmation. To be entitled, employers need to be enrolled in E-Verify, evaluate copies of employment authorization and identity credentials, keep copies of all documents reviewed, carry out a live video interaction with the operative, and generate an E-Verify case for new recruits.
Changes in the Revised Form I-9
It should be noted that the re-evaluated Form I-9 launched numerous modifications to modernize the process. The form has been cut to a single-sided page, intended to be fillable on mobile devices and tablets. The “Preparer/Translator Certification” segment in Section 1 has been relocated to a separate individual supplement, and Section 3, relating to Re-evaluation and Rehire, has also been moved to its own section.
Transition to the New Form
According to a recent announcement, the new Form I-9 (edition date 08/01/23) will be obtainable on the USCIS website from 1 August 2023. Organizations may carry on utilizing the present Form I-9 (edition date 10/21/19) until 31 October 2023. From 1 November 2023, all organizations need changeover to utilize the new Form I-9.
Lastly, Organisations must familiarize themselves with these modifications and carry on applying new practices to remain compliant with these new changes announced by the US Department of Homeland Security.
