Extended Time for Visa Holders to Find Employment
The Australian Government has announced significant updates to visa conditions 8107, 8607, and 8608, impacting holders of the Temporary Skill Shortage (subclass 482) visa, Temporary Work (Skilled) (subclass 457) visa, and Skilled Employer Sponsored Regional (Provisional) (subclass 494) visa. One key change is the extended time given to visa holders to find new employment if they stop working with their current sponsor:
- Temporary Skill Shortage Visa (subclass 482):
Now allows up to 180 days at a time or 365 days across the visa period to find new employment, compared to the previous 60 days. - Temporary Work (Skilled) Visa (subclass 457):
Similarly updated to allow up to 180 days at a time or 365 days in total, up from the previous 60 days. - Skilled Employer Sponsored Regional (Provisional) Visa (subclass 494)
Aligns with the 180/365 days rule, offering more flexibility than the previous 90 days

Increased Flexibility in Employment for Visa Holders
The updated conditions provide greater flexibility for visa holders seeking new employment.
Now, visa holders can:
- Work for other employers and in different occupations after ceasing work with their sponsoring employer.
- Support themselves financially during the job search period.
However, visa holders must continue working in their nominated occupation with their current sponsor until they officially cease employment.

Sponsors’ Obligations
Sponsors must notify the Department of Home Affairs within 28 days if they cease sponsoring the visa holder or if the visa holder resigns from their role.

Conclusion
These changes aim to reduce worker exploitation and provide a fairer system for temporary migrants. By extending the time to find new employment and allowing flexibility in job roles, the amendments are designed to reduce worry among visa holders and support them financially during transitional periods.
