If you are applying for the EU Settlement Scheme, you should know about recent changes.If you face a decision that seems incorrect due to a case working error, you can challenge it through Administrative review, which the Home Office will later on check, and they will decide whether it’s correct.
What Are The Upcoming Changes?
Recently, The Home Office has published a Statement of Changes to the Immigration Rule, which will declare the removal of the right of Administrative Review for decisions on EU Settlement Scheme applications. This change will be effective from 5 October 2023.
This change will impact the following applications:
- Pre-Settled Status
- Settled Status
- Family Permit Applications.
What Can Applicants Do?
According to the Citizens’ Rights Agreement, applicants of the EU Settlement Scheme will still rightfully be able to appeal to the First-tier Tribunal. Through this, a judge from the Home Office will review the decision.
