What are the Quickest Routes to Get ILR Status?
The following are some of the quickest routes to getting IRL status in the UK.
Global Talent Visa Route
Global Talent route is still open to initial main applications and it provides the quickest period to settlement. It replaced the Tier 1 Exceptional Talent visa and is for those people who can show that they are potential leaders (classed as promising) or leaders (classed as talented) in the field of science, arts, medicine, humanities, culture, engineering, and digital technology. For many individuals, this route depends on getting an endorsement from authorized endorsing bodies.
- After continuously residing in the UK for 3 or 5 years, you can obtain an ILR. The following can obtain a 3-year continuous ILR route:
- Those who are able to show that their initial application was granted on the basis of having an eligible prize which is listed in the Appendix Global Talent: Prestigious Prizes;
- Those approved by either the Royal Academy of Engineering, British Academy, Royal Society, or UK Research and Innovation, or;
- Those Endorsed by Tech Nation and Art Council England as recognised leaders in their respective field that is recognised as an individual demonstrating exceptional talent.
The 5-year continuous route to settlement is for individuals who are endorsed by Tech Nation or the Arts Council of England within the criteria of their exceptional promise.
Innovator Visa Route
Those innovative individuals who want to initiate a business in the UK based on an innovative, scalable, and practical business idea can take this route. To use this route, individuals must have either prompted the idea or contributed significantly to it. Innovators should at least have £50,000 to invest in their business and need to have a developmental or managing role in their business on a daily basis. An endorsement from an authorized endorsing body in the UK is also required. A key limitation is that those who use this route can only work for their own business. Potential changes to the immigration rules are expected so if you are interested in taking this route, make sure to stay updated.
After spending three years in this category, indefinite leave to remain (IRL) can be obtained. This is a less complex route to make an initial application if you have the endorsement and investment funds in place, however, you need to navigate settlements through this route attentively with expert immigration advice to make sure that you meet the detailed and strict requirements. The requirements involve making sure that you have an endorsement in hand and showing that you have achieved significant success compared with the business plan provided for your earlier endorsement, for example, demonstrating that you have at least created 5 or 10 full-time jobs for those residing in the UK.
Tier 1 Investor Visa Route
The Tier 1 Investor visa category is no further opened to new initial applications and those wishing to switch into the routes. However, those on the routes at the present have the chance to obtain IRL status but it is time-limited, which is 05 April 2025 for those on the Tier 1 Entrepreneur route and 17 February 2028 for those on the Tier 1 Investor route.
As a Tier 1 Investor, settlement can occur after 2, 3, or 5 consecutive years. This route for indefinite leave to remain is for individuals with high net worth who make a considerable financial investment in the UK. Consequently, this fast route is associated with the amount of money someone has invested in the UK. Those individuals who maintain an investment of £10 million can acquire ILR after 2 years, a fast period of 3 years for those who maintain an investment amount of £5 million, and 5 years for individuals who invest £1 million or £2 million, the amount varies on the basis of rules that were in order when an individual obtained their Tier 1 Investor entry clearance status.
Tier 1 Entrepreneur Visa Route
The Tier 1 Investor visa category is also closed to new initial applications and those wishing to switch into the routes. You can apply for settlement before 05 April 2025 if you are currently in the UK with a Tier 1 Entrepreneur visa.
An individual, who has either created 10 full-time jobs or has a business with a revenue of at least £5 million, can obtain IRL status at a fast rate of 3 years. Those who are not able to fulfill these requirements can obtain ILR status after 5 consecutive years in the UK by fulfilling the requirements which show that they have, for example, invested £200,000 or £50,000 while doing business in the UK, have created 2 full-time jobs for those settled in the UK and these jobs have continued for at least 12 months and the person is still a business director.
