The Australian High Court has ruled a trail-blazing decision to consider the indefinite detention of immigrants as unlawful. This decision would align the country’s policies with international human rights standards while revoking 20-year long-established practices.
This decision, which was made on November 8, 2023, was made in response to a case involving a Rohingya refugee who was stateless. It brought to light the difficulties and humanitarian issues associated with immigration detention practices.
According to the Home Affairs Department, this groundbreaking change could result in the immediate release of 92 individuals who fall under the following circumstances:
- Those who cannot return to their country of origin
- Refugees and stateless individuals
The detention of 340 additional individuals in long-term detention also remains uncertain.
