Which Countries Are Eligible For H-2a And H-2b Visas?
In this blog, we will go through the country’s eligibility for H-2A and H-2B visa programs, as announced by the DHS.
As per the law enforced by DHS, they can upgrade the list of eligible countries anytime by publishing a notice in the Federal Register if any country fails to meet the requirements to continue the designation.
The H-2A and H-2B visa programs will allow US employers to hire foreign nationals to fill temporary agricultural and nonagricultural jobs.
The petitions for both visas approved by the USCIS are only applicable to the nationals of the countries with the eligibility to participate in the program assigned by the secretary of homeland security.
H-2A and H-2B petitions will only be approved by the USCIS of nationals from countries that are designated eligible by the secretary of homeland security to participate in the programs .
However, in certain cases where the United States could benefit, H-2A and H-2B petitions of nationals who are not on the list could be approved by the USCIS. This also includes petitions that were pending since the Federal Register Notice publication.
From November 10 nationals from countries that are eligible will receive H-2A and H-2B visas. For the complete list of countries that are eligible click here.
