What used to be Appendix FM has now been replaced by the brand new Appendix Adult Dependent Relative.
What’s The Reason Behind The Changes?
Well, the Law Commission had recommended a complete redrafting of the Immigration Rules to make them more straightforward and easily accessible for applicants. The government listened and did a whole simplification of these rules, including a fresh rewrite of the Adult Dependent Relative rules.
Requirements For Eligibility and Evidence
As far as eligibility is concerned, there’s not much of a change. The bar for an Adult Dependent Relative visa remains as high as it was before. But, what they’ve done is to move the evidential requirements, where they made sense, from the old Appendix FM-SE into the new Appendix. It’s made the whole thing a lot easier to grasp than before.
Requirements For Maintenance Undertaking
This is a fancy way of saying that the sponsor needs to sign a commitment. It’s to ensure that the sponsor can look after, house, and care for the applicant for a period of 5 years from when the applicant arrives in the UK, without relying on public funds.
Impact of the New Appendix
Well, the new Appendix Adult Dependent Relative is a step in the right direction as the government continues to make things simpler. But, the high bar for eligibility hasn’t budged, which means that, even though the rules are clearer now, it doesn’t look like we’re going to see a dramatic surge in successful new applications.
