Green Card Application Fees to Skyrocket Under New Proposal

The USCIS fee is effective from early 2024 for almost all immigration applications.

The United States Citizenship and Immigration Services (USCIS) is currently administering notable changes to its fee structure. According to the current update from the American Immigration Lawyers Association (AILA), the Office of Information and Regulatory Affairs (OIRA) completed its USCIS Final Fee Rule review on January 19, 2024. On January 8, 2024, OIRA received the final rule with considerable increases in immigration fees. Given that the last fee was adjusted eight years ago, the Administration may fast-track the finalization of this rule.

On January 4, 2023, the proposed rule suggested an overall weighted average rise of 40% in application fees. AILA and the American Immigration Council have expressed their concerns, emphasizing that the new fee structure would mean notably higher costs for employers and applicants.

Moreover, their concerns included doubling total fees from $1760 to over $3640 for numerous marriage-based green card applications, including the mandatory I-130 petition for a family member. Finally, fees for accompanying children will no longer be decreased, and their costs will mirror adult applications. To sum it up, for an immigrant family of four, the costs can exceed $10,000 to bring a spouse and two children to the United States, according to this new fee proposal.

The prices of other immigration applications are also set to increase:

  • The fiancé visa petition will increase 35% from $535 to $720
  • The petition for a relative will rise 53% from $535 to $820
  • The removal of conditions application will increase 76% from $680 to $1,195





 

When Will These Changes Come Into Effect?

The petition for the final rule will be declared as soon as OIRA completes its review, indicating that the new fees will be in effect by Spring 2024. However, this rise in cost will not affect the applications postmarked before the rule goes into effect.
